NERC Has Tantrum Over FERC Audit

Don't you just love the smell of audits in the morning?  I happened to catch this article on Friday.  It seems that FERC (Federal Energy Regulatory Commission),  performed an audit of NERC (North American Electric Reliability Corporation) over several months last year.  NERC didn't like FERC audit staff's findings and now they're having a big, ol' public tantrum about it and whining to the FERC Commissioners.  NERC thinks they are somehow "special" and should have been permitted to "work toward resolution" (read "sweep under the rug if we promise not to do it again") instead of being held accountable for their actions.  Because NERC decided to have a tantrum and contest the audit findings, the whole thing got made public on Friday.  Not too smart, NERC!

NERC describes its mission as: "to ensure the reliability of the North American bulk power system. NERC is the electric reliability organization (ERO) certified by the Federal Energy Regulatory Commission to establish and enforce reliability standards for the bulk-power system. NERC develops and enforces reliability standards; assesses adequacy annually via a 10-year forecast, and summer and winter forecasts; monitors the bulk power system; and educates, trains and certifies industry personnel."

NERC's statutory authority, once designated the ERO by FERC, comes from Section 215 of the Federal Power Act, and they may "allocate equitably reasonable dues, fees, and other charges among end users for all activities under this section;"  I didn't see a definition for "end users" in the FPA, but I will assume "end users" are electric consumers/ratepayers.

So, what did the audit turn up?  Lots of interesting stuff, including a couple of "Holiday Galas" NERC held in 2010 & 2011 that cost us ratepayers $74,748 and $109,474, respectively.  The totals included expenses such as travel, lodging, car rentals, "gifts," food and beverage, entertainment and "miscellaneous."  NERC prefers that FERC audit staff refer to them as "year-end events, or year-end employee dinners and meetings" (pg. 63), although the term "Holiday Gala" came from internal NERC documents.  NERC advertised the parties as "Holiday Galas" in-house, but when the auditors showed up they called them "year-end events."  You can download a copy of FERC's audit report here.  The Holiday Gala stuff starts on page 52 of the report.

So, while senior citizens on a fixed income and single parents are struggling to pay their monthly electric bills, NERC is spending nearly $185,000 on holiday parties.  Nice.  NERC is statutorily permitted to spend funds on activities necessary for its duties under Sec. 215.  Are Holiday Galas necessary to the reliability of the electric grid?  I wonder if there was no holiday party for NERC employees if the lights would have gone out?  Maybe we'll find out in 2012 :-)

NERC needs to get off its "special" pedestal and learn how to behave during an audit.  Don't argue with the auditors, you're not going to win.  Auditors are like The Child Catcher from Chitty Chitty Bang Bang, "There are improper expenses around here somewhere... I can smell them!"  If there's one transaction that isn't quite right in a computer printout 3 inches thick, an auditor will zero in on that particular transaction and start asking for documents, guaranteed.  Quit your whining, NERC, and clean up your act!

And, from an electric ratepayer's perspective... Thank you, FERC audit staff!  We appreciate you, even if NERC doesn't.

I'm glad Ferc uncovered Nerc's gravy train. That's what Ferc is supposed to do. They should not let Nerc get away with this!!!!!! I also thank Ferc's auditors; good job! Let's not let political lobbying cover this up! This nonsense is all part of what makes my electric bill so hard to manage

Then again, why did it take Ferc so long to find out all this when they are supposed to be reviewing and approving Nercs budget every year?!?!

Shades of GSA!

It would be nice if NERC's "leaders" would follow Martha Johnson's example and fall on their swords to make amends, but we all know they are too arrogant, too greedy, and too shortsighted to change their ways.

But ... their time is coming. Sooner or later ratepayers are going to realize that we're all nothing but fresh meat for these vultures and start fighting back.

As we do every day on this blog and The Power Line! Information is power - and unlike electricity, it doesn't lose potency the further it travels. If anything, it gains strength!

Have a cup of my special brew, Dave! If the people complaining about high electric bills only knew that the problem isn't the EPA but the industry gravytrain provided by the regulators sworn to protect consumers there would be anarchy!

My take from reading the audit report is that the "holiday galas" weren't in the budget, as such, but were funded by "left over" budget funds that weren't spent on budgeted programs. So, the more corners NERC cuts during the year, the bigger the budget for the holiday shindig. And NERC seems to see it as a well-deserved "reward" for their "efficiency."

nsider, you are EXACTLY right! Why is FERC only now finding this crap, 'cause you know it's gone on for ages.
But it's consistent with what our "two housewives from WV" found when they started looking at the expenses PATH keeps trying to shovel down ratepayers' throats - the country club memberships, the lobbying expenses, the "educational" advertising that's actually propaganda. And when Keryn and Ali asked about FERC's process for reviewing expenses to which the "incentive ROE" is applied, the answer was, "Oh, that's for others to do."
So what the @$% is YOUR job, FERC? Making sure that citizens swallow?

NERC cutting corners to fund parties is very scarey. How far will they go? When the lights go off will nerc be sipping dom perignon and enjoying escargot on our dime? The fox is watching the henhouse here and nerc is not serving the people who fund them. If there are any efficiency savings to be had they belong to the people who fund nerc, not to nerc employees to pay for their personal parties.

The investigation into PATH expenses showed clearly that the formula rates for transmission do not work as intended. FERC set up a system whereby it is presumed that utility expenses are prudent but put the onus on end users to monitor. As the can of worms came open, the fact came out that no one end user had enough interest at stake to make it fiscally prudent to spend inordinate amounts of time and expertise combing through annual filings. Therefore, the onus got shifted back to FERC to do occasional audits. FERC just doesn't have the funding or staff to audit every one of them every single year. The utilities know all this, in fact they set up the system just this way through political influence, so they got bolder and bolder with their expenses because no one was minding the store and the chances of a random FERC audit were slim. But then the ratepayers showed up -- no budget, no cost for their time -- simply principles, and the utilities' house came crashing down. The utility reaction was to attempt to cut ratepayers out of the process and remove their rights to act as a conscience to both the utilities and FERC. That demonstrated what a farce the whole formula rate scheme was from the very beginning. I hope FERC can fix that and restore consumer confidence.
